1 About this privacy declaration and the contained notes

We are pleased by your interest in our Web page and our company. The protection of data of our customers
during collection, processing, and usage on the occasion of your visit of our Web page is for us of utmost importance.
Therefore atecom realizing visions GmbH (below atecom) will process personal data in accordance to all applicable
legal regulations for protection of personal data and data safety. On our Web page personal data is only collected as far as
technically required. The collected data will not be sold or otherwise published to unauthorized third parties.
Our privacy declaration fully complies with the directives of the General Data Protection Regulation (GDPR) and the German
Data Protection Act (BDSG). It should inform you about the form, purpose, and use of personal data by atecom and
also about your legal rights.

3 Collection of personal data and information

3.1 By visiting our web page

When visiting our Web page www.atecom.com information and user data are automatically
send by your Web browser to our Web server. These information are stored in a log file on the server. The stored data sets contain the following information:

  • Date and time of the access
  • The name of the accessed Web page
  • The IP address of the remote computer
  • Referrer-URL (the URL with the link to our Web page)
  • Product- and version information of the browsers
3.2 By using the contact form

For getting in contact with atecom you can use the contact form on our Web page. You will be requested to provide the following information:

  • First- and family name
  • Organization
  • Email address
  • Phone number
3.3 By registering for our newsletter and proprietary product information

To get access to additional proprietary product information from atecom you are requested to register to our customer portal first. For the registration the following information is required:

  • First- and family name
  • Organization
  • Position
  • Your work email address
  • Phone number
  • Street, number
  • Postal, City
  • Country

After registration you get access to proprietary content, i.e firmware upgrades, white papers, training materials, certificates, etc. for single products or product groups. Further on you can subscribe to automatic notifications in case of changes to the selected data. You can change your preferences at any time within your local profile settings.

 

3.4 By issuing a RMA request (Returned merchandise authorization)

To ease processing and tracking of repairs by issuing a RMA request the following information must be provided:

  • First- and family name of the requestor
  • Organization
  • Full return address (Street, number, postal, city, and country)
  • Name of a contact person
  • Email address of the contact person
  • Phone number of the contact person
  • Serial number of the defective product/part

 

This information is required to ignite a proper repair and return of the goods without any time lag.

 

4 Google Analytics

 

This Web page uses Google Analytics, a Web analyze service of Google Inc. (“Google”). Google Analytics uses “Cookies”, text files, which are stored on your computer and allow analysis of your personal use of our Web page. The information generated by the cookie usually will get transfered to a Google server located in the US. In case of IP anonymization on this Web page Google will shorten your IP address within the European Union (EU) or other member states of the European Economic Area (EEA).

Only under exceptional cases your IP address will be transfered to the Google servers in the US and afterwards shortened.
On behalf of atecom Google will use this information to provide information about your use of the Web page, generate reports about activities on the Web page, and to provide additional services related to Web page and Internet use.
Your IP address, captured by Google Analytics will not get combined with other information collected by Google.

5 Use of cookies

 

Our Web page uses cookies at several points. Cookies are used to achieve a higher ease of use, efficiency, and security of our service. Cookies are small text files stored by the browser on your computer. Most of the cookies used by our Web page are so called “Session cookies” which will get deleted after closing the browser window. Cookies are save and do not contain any virus.
Most browsers are configured by default to accept cookies. You can deactivate the storage of cookies by changing the settings within your browser. In this case atecom be not guarantee, that all functionality of the Web page will be still available.

 

6 Data processing

 

6.1 Purpose of data processing

Data collection and processing is performed to ease communication, and to establish, perform and extend business relations with our customers.

 

6.2 Sources and categories of personal data

atecom processes personal data received from you or an representative in the context of our business relation for the purpose mentioned above. Relevant information can include:

  • First- and family name, Address, phone number, mobile phone number, fax, Email address, IBAN, BIC, VAT-ID, and other contact data.
  • further information, required for handling of a project or execution of contractual relationship with atecom, i.e order history and project details, and information available to the public.

 

6.3 Legal basis

With your agreement – §§6.1 lit. a GDPR:

Insofar you agreed with processing of your personal data the legitimacy of the processing is given based on your acceptance.

For execution of contractual obligations – §§6.1 lit. b GDPR:

The processing of personal data takes will be carried out place in the scope of order processing and service activities,
transactions, or execution of your orders.

Due to legal regulations – §§6.1 lit. c GDPR:

atecom is subject to several legal obligations, which require the transfer of personal data, i.e. obligations to inform public agencies.

Due to interests considerations – §§6.1 lit. f GDPR:

As far as required, personal data will be stored after completion of the contract for protection of interests of atecom or third parties. Legitimate interests are given in case of contact or information requests, customer care,
IT security, or enforcement of legal claims.

6.4 Duration and criteria for data retention

Your personal data will be stored for the duration of our business relationship. In addition atecom is
legally obligated to store data according to commercial and tax laws, with durations up to 10 years. Furthermore legal prescription periods can require a storage of data up to 30 years (BGB §§195 ff.), whereby the usual prescription period is 3 years.

7 Transfer to third-parties

Within our organization only personal data required for proceeding contractional or legal obligations is published to employees, involved in execution. External service suppliers (§§28 DGPR), i.e. IT consultants, controlling, etc., can get access to personal data for fulfilling tasks listed under 6.1. The external service suppliers will only act on advice of atecom and are contractually obligated to follow all legal rules for data and privacy protection.
atecom will publish your personal data to other third parties only with your permission.
As a global acting company we must ensure, that or partners involved in a project have the same state of knowledge. For this reason we will provide partners information required to carry out the project in accordance with all legal regulations.
atecom will publish personal data to law courts, regulatory authorities or lawyers, if necessary to enforce or defend legal claims.

8 Transfer of personal data to foreign countries

A transfer of personal data to foreign countries outside the EU or EEA will be carried out only under strict observation
of the applicable legal regulations. If within the country the applicable law foresees a lower level of data protection than within the EU atecom will take appropriate actions to ensure protection of personal data.

9 Obligation to supply personal information

You are requested to provide only personal data as required by the contact, RMA, or registration form.
Without this information we will not able to process your request.

10 Rights of affected person

You have the right:

in accordance to §§15 DGPR to request information about your personal data processed by atecom;

in accordance to §§16 DGPR to request immediate correction and update of your personal data stored by atecom;

in accordance to §§17 DGPR to request deletion of your personal data stored by atecom;

in accordance to §§18 DGPR to restrict processing of your personal data in case a condition of §§18.1 is given;

in accordance to §§20 DGPR to receive your personal data stored by atecom in a structured and machine-readable format;

and in accordance to §§77 DGPR to raise complains at controlling authority.

11 Right of revocation and objection

You can revocate your agreement at any time (§§7.3 DPRG), also agreements dated before May, 25th, 2018.
After revocation atecom is only allowed to further process your personal data, as far as another legal base is applicable.

12 Changes to this Privacy Declaration

 

Due to constant enhancements to our Web page and offered services or because of changes in the legal rules changes to this
privacy declaration might become necessary. You can download the actual valid version of the privacy declaration from www.atecom.com.
